4.SHIPPING

>Refusal to process to an Order
VYB reserves the right to remove any Product displayed on the Site at any time and to replace or modify any content or information appearing on the Site. Despite VYB's best efforts to satisfy its customers' expectations, VYB may refuse to process an Order after having sent the Customer the confirmation e-mail summarizing the Order.
VYB shall not be liable to the Customer or to any third party for the harmful consequences of the removal of a Product from the Web site, or the replacement or modification of any content or information appearing on this Web site, or the refusal to process an Order after the confirmation e-mail summarizing the Order has been sent.

The prices of items displayed on www.reikojeans.com may differ from those in the physical stores where REIKO JEANS items are sold.
Notwithstanding the foregoing, if VYB discovers an error in the price of the products ordered, VYB reserves the right to cancel the order and invite the Customer to reorder the products at the correct price. If VYB is unable to contact the Customer, it will treat the order as cancelled. In these circumstances, if payment has already been made, the Customer will be refunded the cancelled order by VYB.
The amount of the transport costs relating to the delivery of the articles will be automatically displayed on the Site at the time of the validation of the mode of forwarding chosen by the customer and will be communicated again to the customer at the time of the confirmation of his order by email.
The confirmation of the price paid and the delivery costs charged to the customer in the form of an invoice in Euro currency is available to the customer on his personal account accessible from the Site. The amount due by the customer is the amount indicated on the order confirmation sent by e-mail to the customer.
The payment will be carried out, except unavailability of the waiter, immediately on Internet - by Bank card (MasterCard or Visa) - by account PAYPAL: the customer will be then automatically directed on his account PayPal. Once the PayPal payment is validated, the order is completed.
The Company VYB reserves the right to refuse any order or any delivery in the event of litigation existing with the customer, in particular in the event of: total or partial non-payment of a preceding order by the customer, in the cases where a litigation of payment would remain, of refusal of authorization of payment by bank card of non-payment or partial payment, of use of a Bank card not delivered by a European financial establishment and of non-availability of the products, if the customer engaged in a fraudulent activity, or for any other legitimate reason. VYB cannot be held responsible in this case.
We keep the full property of the products in sale, until the perfect collection of the totality of the sums due on the occasion of your order (expenses and taxes included).
However, as of the reception of the goods, the load of the risks is transferred to you. You must therefore ensure the proper preservation of these goods.

Delivery is made to the address you provided when you placed your order.
When the ordered article is available in stock, the delivery of the articles can intervene only after complete cashing of the payment of the order, with the address of delivery indicated by the customer. VYB reserves the possibility of splitting the deliveries within reasonable limits, so that you obtain the ordered products as soon as possible. Your credit or debit card will be charged in the same way to correspond to the price of the products actually delivered.

Except during periods of sales or promotions, all validated orders are shipped the next business day. In case of unusual delay, an e-mail will be sent to you. During sales or promotions, orders are shipped within 2 to 12 days.
The times indicated are the estimated times announced by our transport providers, in working days.
VYB reserves the right to refuse to deliver ordered items to "post office boxes" or "poste restante", or to collective addresses such as offices, care or residential establishments, student residences. In any case, in such a case, the customer recognizes that the obligation of VYB for the delivery of the order stops at the effective delivery to the collective address indicated by the customer on his order form, even if the parcel is not received by the customer but by a third party.

A delivery deadline will be communicated to you before the validation of your order, taking into account the choice of the carrier. The applicable delivery times are those indicated during the validation of your order. They begin to run from the time the order is shipped.

UK - IN THE CONTEXT OF BREXIT

11.3 - Delivery conditions for shipments in Metropolitan France
Shipments for deliveries in Metropolitan France and Corsica are handled by LA POSTE or by the carrier CHRONOPOST.

11.4 General conditions of delivery and reception
Packages are given in conformity to the carriers who are responsible for their routing. In case of non-conformity during delivery (envelopes or cardboard boxes with visible traces of opening and/or deterioration), you must make reservations on the delivery note or refuse the goods. In the event of non-observance of these provisions, the responsibility of VYB.com cannot be committed. In this case, your order can neither be re-delivered, nor refunded.
The parcels leaving the warehouses of VYB are in perfect state and must be delivered to you in this state. If no reservation has been made, we will not be able to take into account possible disappearances, nor to respond positively to a request for compensation.
In spite of all the care taken by VYB in the preparation of the packages, it is nevertheless possible that a product is missing. Similarly, after the package has been transported, one of the products may be defective. This is why, at the reception of his order, the customer will take care to check the conformity of the received products. Any anomaly concerning the delivery (missing or defective product, damaged parcel) must imperatively be notified, the same day of the reception or at the latest the first working day following the reception, to the VYB customer service, by informing us at the following address: help@reikojeans.com or by registered mail (addressed to VYB SAV: 148 Traverse de la Martine -BAT 2 - 13011 Marseille, France) date of the post office being taken as proof. Any complaint formulated after this deadline cannot be taken into consideration and VYB will be released from any responsibility in this respect; VYB reserves the possibility of asking the customer to return the defective product. If the above-mentioned conditions are met, VYB will then proceed to issue a credit note, with a view to reimbursing the defective Product(s), or to reship the missing Product (subject to the validity of the Purchaser's request).
VYB declines any responsibility in the event of too great a delay in delivery due to the postal services or the means of transport, as well as in the event of loss of the ordered products or strike.

In case of force majeure or exceptional events (natural disaster, epidemic, strikes, lock-out, etc.) delaying or prohibiting the delivery of goods, VYB is released from any responsibility. In any case, delivery on time can only be made if you are up to date with your obligations towards VYB.
You profit from a right of retractation during a 14 clear day deadline as from the reception of the Articles. When this period expires on a Saturday, a Sunday or a holiday, it is extended until the next working day. You do not have to justify your withdrawal.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail).
You can use the sample withdrawal form, but this is not mandatory.
In order for the withdrawal period to be respected, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.

The Customer recognizes that the proof of his retraction can be established by the computer records of the Company VYB or its service provider. Once the right of withdrawal has been notified under the above conditions, the reimbursement to the Client of all or part of his/her order is conditional upon the physical return by the Client to VYB of the items concerned in his/her order.

Before returning an item, you must register your request in order to print a "Return Form". You will be able to download it directly from your customer area in the "My product returns" section.
Return shipping costs in France by "Colissimo" are offered to customers (except Outlet and Braderie).
The return of the Articles must take place within 14 days from the date on which the customer has informed VYB of his decision to withdraw. Any return made after this period will not be taken into account. The "Return Form" must be attached to the returned items. The items are returned at the Customer's risk to the address indicated on the "Return Form".
All returns must be accompanied by a copy of the invoice.
Items must be returned complete, carefully packaged, in the original packaging, and accompanied by all documents, elements and accessories that were in the original packaging, including the plastic sleeve and label.
The customer is free to choose the mode of sending of his product and to subscribe or not an insurance in the event of loss, theft or destruction of his parcel. The Company VYB does not take in charge any of these expenses nor the cost of transport and could not be held for person in charge of the non reception of the parcel of the customer. In general, all the expenses and risks related to the return of the product are the responsibility of the sender.
In the event of your withdrawal from this contract, we will refund all payments received from you without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will make the refund using the same method of payment that you used for the original transaction, unless you expressly agree to a different method; in any event, this refund will not incur any costs for you. It will be up to the customer to keep all proof of return, which supposes that the articles are returned by registered mail or by any other means giving certain date to this sending. The company VYB will proceed to the exchange of defective article(s) by (s) (product(s) identical to that (those) ordered, within the limit of available stocks, or product(s) of equivalent quality and price, within the limit of available stocks) or to the refunding according to the wish of the customer. In the absence of a possible exchange of the returned article(s), the reimbursement of the invoiced price of the non-conforming articles returned will be carried out, by re-crediting the bank card having been used for the payment of the order, at the latest within 30 (thirty) days following the reception by the Company VYB of the returned article.
The costs of returning the product ordered and delivered to the Customer will be borne by VYB if it is a defective product or an error in the processing of the order.
We draw your attention especially to the fact that the guarantee does not cover the normal wear of a product and the non-observance of the instructions of maintenance of the articles.
If one or more stipulations of the present general conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their range.

These Terms and Conditions are written in English and French. In the event that they are translated into one or more other languages, only the French or English text will be deemed authentic in the event of a dispute.

Annex 1: Provisions of the Consumer Code concerning the legal guarantee of conformity
Article L211-4
The seller is obliged to deliver goods in conformity with the contract and is responsible for any lack of conformity existing at the time of delivery.
He is also responsible for defects in conformity resulting from the packaging, the installation instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility.
Article L211-5
To be in conformity with the contract, the good must :
1° be fit for the purpose usually expected of similar goods and, where applicable :
